Frequently asked questions

  • When should an early warning notice be issued under NEC4? Under NEC4 clause 15.1, the Project Manager or Contractor should give an early warning as soon as they become aware of any matter that could increase the Prices, delay Completion or a Key Date, or impair the performance of the works in use.
  • What is a compensation event under NEC4? A compensation event is an event listed in the contract, such as a change to the Scope or a Client's failure to provide access, which, if it happens and is not the Contractor's fault, entitles the Contractor to an assessment of changes to the Prices and Completion Date.
  • How long does a Contractor have to notify a compensation event under NEC4? The Contractor must notify a compensation event within eight weeks of becoming aware that it has happened. If it does not, it may lose its entitlement to a change in the Prices, Completion Date or Key Dates, unless the Project Manager should have notified it.
  • What are the main differences between NEC3 and NEC4? NEC4 introduced clearer language, a final assessment process, an optional dispute avoidance board (W3), early contractor involvement options, and changes to programme acceptance and the treatment of disallowed cost.
